Other teacher vacation benefits, such as study leave and indeterminate sick leave, are covered by Sections 24 and 25 of Republic Act 4670 or magna Carta for Public School Teachers. As defined in Section 9 of the Circular Memorandum (MC) 41, p.1998 of the Public Service Commission, vacation credit is used for services provided during the summer or Christmas holidays, as authorized by the competent authority, or beyond normal duties or beyond regular working hours/days for which it is not possible to pay fees during the regular school year. During the holidays, teachers are entitled to at least sixty per cent of their monthly salary. PASIG CITY, September 28, 2018 – The Ministry of Education (DepEd) says teachers are entitled to vacation credits that serve sick and leave. Teachers who are engaged in non-pedagogical duties and who perform the same periods of service as other workers are entitled to leave and sick leave in accordance with SCC MC 41, p. 1998. During the duration of this leave, teachers are entitled to at least sixty per cent of their monthly salary: however, provided that no teacher can accumulate more than one year of leave, unless he needs an additional semester to complete his doctoral thesis for studies in training or related studies: provided that the teacher is not entitled to compensation after the first year of that leave. In all cases, the study leave is counted for seniority and retirement purposes. This paid study leave would be a great opportunity for teachers who wish to continue their studies without having their financial consequences. The authorized remuneration for one year of study leave, as provided here in this area, is conditional on the teacher taking over the normal responsibility of the study and carrying out at least 75 per cent of his courses. Study leave of more than one year may be authorized by the Minister of Education without compensation. Indeterminate leave is granted to teachers when the nature of the illness requires long-term treatment of at least one year. A teacher applying for indeterminate sick leave should submit a medical certificate (CS form 41) and an application for leave (Form CS 6) indicating the maximum number of days the teacher should take on leave, subject to a change, as recommended by the government physician.
